23 Legal Defenses to Foreclosure breaks down 23 powerful foreclosure defenses into easy-to-understand chapters. Each chapter is packed with useful information that you can use directly in court in any state. The book includes: legal letters, forms, motions, an "Answer" to the lawsuit, and sample discovery to get damaging information directly from the bank. It includes recommended strategies for fighting foreclosure, and checklists that make this book easy enough for anyone to understand. Each chapter incorporates a section of the possible damages available for each defense - including how to cancel the loan and get a refund of all money paid to the lender. Defenses include TILA, HOEPA, RESPA, FDCPA, FCRA and more.
This book was written by Troy Doucet, the administrator of this website.
Troy Doucet is a Capital University Law School graduate, magna cum laude, who assists attorneys throughout the United States in their efforts to combat foreclosure. He regularly audits loans for TILA and HOEPA violations, as well as for the other defenses contained in his book, 23 Legal Defenses to Foreclosure: How to Beat the Bank. He published 23 Legal Defenses in August, 2008, then published an integrated copy of Regulation Z in 2009, titled Regulation Z of the Truth in Lending Act: 12 C.F.R. Part 226. He has appeared several times on CNN’s Houston radio affiliate, CNN650, discussing foreclosure and debt collection law. He held a foreclosure audit training seminar in Washington, D.C. for a team of attorneys.
Mr. Doucet owned a mortgage firm for several years, fighting tirelessly to save homeowners money. In 2004, Broker magazine featured him as its cover story when he proposed the mortgage industry eliminate junk fees from all mortgages. Mr. Doucet eliminated all junk fees from his company’s loans early on, and grew the firm quickly. In 2006, Mr. Doucet left the industry to pursue academic goals.
Mr. Doucet completed law school in Columbus, Ohio, ranked in the 5th percentile of his class. He has taken multiple consumer and litigation based classes, earning the top grade in Real Estate Finance Law and Legal Drafting (Transactional). “I have just finished reading your book for the 2nd time (in a week)…. I teach continuing education to attorneys, Mortgage Brokers, Realtors, CPA’s and Financial Planners, currently on the topic of foreclosure and loss mitigation techniques. Kudos for putting together such a fantastic resource!!!!”

“I found the book to be very helpful. I found the book very easy to navigate. I especially liked the bullet points in each chapter stating whether the defense would apply to the reader's situation.
